Ownership and Control of Customer Content:

Access: We will implement and manage access to your content and portal based upon your instructions to use. We provide an advanced set of role-based access control, encryption, and logging features to do this effectively. We do not access or use customer content for any purpose other than as legally required and for maintaining your portal and providing them to your end users.

Storage: When you order, you will choose the region(s) in which your content will be stored. We will not move or replicate your content outside of your chosen region(s), except as legally required and as necessary to maintain your portal access to your end users.

Security: You choose how your content is secured. Your content will be encrypted when it is in transit or at rest. We will provide your portal with roles that allows us to control which customers have access to individual items of your content.

Disclosure of Your End-User Data: We do not disclose data about your individual end-users unless we are required to do so to comply with the law or a valid and binding order of a governmental or regulatory body. Unless prohibited by law from doing so, we will notify you before disclosing your end-user data such that you can seek protection from disclosure.

NOTE: We have the right to anonymize and aggregate your End-User data and to combine it with the anonymized and aggregated End-User data of our other customers. The Anonymized End-User will not contain any personal identifiers of your End-Users, the End-Users’ companies, nor your company. All rights and ownership of the Anonymized End-User data vest with Us.

DP.com classifies data into two categories: customer content and account information. We define your customer content as software (including machine images), data, text, audio, video or images that your and your end users transfer to us for processing, storage or hosting on your DP.com provided portal. For example, your customer content includes content information about your products and services that you want to make available to your end-users as well as information that your end-users enter into the portal.

We define account information as information about your employees that they provide when they log into our portal us in connection with the creation or administration of your DP.com customer account. For example, account information includes names, usernames, phone numbers, email addresses and billing information associated with your customer account. The information practices described in the DP.com Privacy Notice applies to account information.

Who Owns Customer Content?

You will maintain ownership of your customer content. We will only access or use your customer content for any purpose other than as legally required and for maintaining the DP.com services that you have contracted from us. We do have the right to anonymize and aggregate all of the End-User data for the purpose of performance and other analysis. The anonymized and aggregated data will not contain any personal identifiers nor will it contain your corporate identity, this anonymized, aggregated data belongs to us.

Who Controls Customer Content?

You will control your own customer content either directly or through the instructions that you provide to us. You will be able to:

  • Determine the geographic region for where your customer content will be stored on your order and you will be able to change that on request.
  • Choose the security level for your customer content by instructing us as to which of your end-users have access to which information. We will set up security roles to reflect these choices.

What About Account Information?

We know that you care how account information is used, and we appreciate your trust that we will do so carefully and sensibly. The DP.com Privacy Notice above describes how we collect and use the account information collected on the developerprogram.com site.

What happens When DP.com Receives A Legal Request For Customer content?

We are vigilant about your privacy. We do not disclose your customer content unless we're required to comply with the law or a valid and binding order of a governmental or regulatory body. Governmental and regulatory bodies need to follow the applicable legal process to obtain valid and binding orders, and we review all orders and object to overbroad or otherwise inappropriate ones. Unless prohibited from doing so or there is clear indication of illegal conduct in connection with the use of our products or services, we will notify you before disclosing your customer content such that you can seek protection from disclosure.

Where Will My Customer Content Be Stored?

You choose the region(s) in which your customer content will be stored, allowing us to deploy your DP.com services in the location(s) of your choice, in accordance with your specific geographic requirements. DP.com and our partner datacenters are built in clusters in various regions around the globe which you will specify in your order form.

For example, an DP.com customer in Australia can choose to deploy its DP.com services exclusively in the Asia Pacific region (Sydney) or choose to store it both in Asia Pacific region and China (Beijing). You can opt to replicate and back up your customer content in more than one region, and we will not move or replicate customer content outside of your chosen region(s), except as legally required and as necessary to maintain the DP.com services and provide them to your end users.

What If My Privacy Policy Is Different Than Yours?

When you create a DP.com portal, your Privacy Policy is the one that is applied to your Customer Content. We will implement and comply with your Privacy Policy to the extent that it does not conflict with ours.
